By accessing or using the Aithera Labs platform at aitheralabs.co.uk (“the Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is operated by Ascendant Ventures Ltd, a company registered in England and Wales (registered address: 66 Paul Street, London EC2A 4NA), trading as Aithera Labs.

If you do not agree to these Terms, please do not use the Service.

Aithera Labs provides a flood prediction and monitoring platform that analyses publicly available environmental data to generate flood risk assessments. The Service includes:

• Real-time flood risk predictions for monitored river locations
• An interactive dashboard displaying water levels and risk classifications
• Email alert notifications for elevated flood risk
• A public marketing website with information about the platform

Access to the flood monitoring dashboard requires authentication. You are responsible for maintaining the confidentiality of your access credentials and for all activity that occurs under your session.

We reserve the right to restrict or terminate access at our discretion.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Scrape, copy, or redistribute data from the Service without permission
• Use automated tools to excessively access the API or dashboard

6. Intellectual Property

The Aithera Labs name, logo, prediction algorithms, dashboard design, and website content are the intellectual property of Ascendant Ventures Ltd. You may not reproduce, distribute, or create derivative works without our written consent.

River level data sourced from the UK Environment Agency is provided under the Open Government Licence v3.0 and remains subject to its terms.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

8. Limitation of Liability

To the fullest extent permitted by law, Ascendant Ventures Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Losses arising from reliance on flood predictions
• Service interruptions or data inaccuracies
• Actions taken or not taken based on alert notifications

The Service is provided “as is” without warranties of any kind, whether express or implied.

9. Service Availability

We aim to maintain the Service at all times but do not guarantee uninterrupted availability. We may temporarily suspend the Service for maintenance, updates, or due to circumstances beyond our control.

Flood predictions depend on third-party data sources (Environment Agency, Open-Meteo). Delays or outages in these services may affect our predictions.

10. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
